The attorney's profession is subject essentially to the following regulations:
- Federal Lawyers' Act
- Federal Schedule of Fees for Lawyers
- Lawyers' Code of Conduct
- Code of Conduct for Lawyers in the European Community
- Regulation for Specialized Lawyers
The professional regulations can be consulted in the Federal Bar Association's website (www.brak.de).
Due to the Federal Lawyers' Act (BRAO), attorneys are obligated to have professional liability insurance for 250,000 euros. The details are specified in Section 51 of the BRAO.
The auditor's profession is subject essentially to the following regulations:
- Auditors' Regulations
- Auditing Regulations
- Occupational Statute of Auditors & Certified Accountants
- Regulation governing the auditors' seal, etc.
- Regulation governing the auditor's professional liability insurance, etc.
The professional regulations can be consulted in the Auditors Association's website (www.wpk.de).
According to the Auditors' Regulations (WPO), independent auditors and auditing companies are required to take out and maintain professional liability insurance. The details are specified in Section 54 of the WPO. The minimum sum insured for the individual insured claim must be 1,000,000 euros.
The tax advisor's profession is subject essentially to the following regulations:
- Tax Advisory Act
- Execution Regulation of the Tax Advisory Act
- Professional Regulations
- Tax Advisors' Fee Schedule
These professional regulations can be consulted in the Tax Advisors Association's website (www.bstbk.de).
According to the Regulation to Execute the Regulations governing tax advisors, tax representatives and tax consulting firms (DVStB), independent tax advisors and tax consulting firms are required to take out and maintain professional liability insurance. Details are specified in Section 51 of the DVStB. The minimum sum insured for the individual insurance claim is 250,000 euros.
Professional liability insurance can be obtained through the HDI Versicherung AG, Postfach 2127, 30021 Hannover. The area covered by the insurance is unlimited.
